This sea is of great importance for the countries of the region in terms of management and legal issues due to its vast oil and gas resources, communication and commercial water lines, marine products, as well as environmental conditions, ecological balance, preservation of the environment and creation of beautiful tourist and natural landscapes in surrounding regions. Since the collapse of the Soviet Union, the four Treaties of the years 1921, 1931, 1935 and 1940 had established a solid legal framework between Iran and the Soviet Union, based on principles such as equality, monopoly, non-military identity of the sea, cooperation and ... However, after the collapse of the Soviet Union and the emergence of the issue of succession in that country and the formation of new states of Turkmenistan, Kazakhstan and Azerbaijan, legal problems have occurred and the policy of some of these newly independent states regarding the sea have raised doubts about the legal status of the Caspian Sea which can bring about undesirable political and economic consequences.  The author, after referring to the legal status of this sea, has analyzed the problems created in its legal regime after the collapse of the Soviet Union using analytical and documentary methods, with conclusion that the existence of a valid, clear and firm legal regime based on previous (existing) treaties, while resolving the existing problems, will strengthen the sovereignty of Iran over the part of the sea in its vicinity.}, keywords = {}, title_fa = {ایران و رژیم حقوقى دریاى خزر «پس از فروپاشى شوروى سابق»}, abstract_fa = {دریاى خزر بزرگترین دریاچه بسته جهان است که در یکى از مناطق مهم استراتژیک تولید انرژى دنیا قراردارد. این دریا با داشتن منابع عظیم نفت و گاز، خطوط ارتباطى و بازرگانى آبى و فرآورده‏ هاى دریایى از اهمیت بسزایى برخوردار است، همچنین به علت ایجاد شرایط زیست محیطى، تعادل اکولوژیکى و حفظ محیط زیست و خلق چشم‏ اندازهاى زیباى توریستى و طبیعى مناطق اطراف، از نظر مدیریت و مسائل حقوقى براى کشورهاى منطقه بسیارمهم است، تا قبل از فروپاشى اتحاد جماهیر شوروى سابق انعقاد معاهدات چهارگانه 1921، 1931،1935 و 1940 شوروى چارچوب حقوقى مستحکمى را بین دو کشور ایران و شوروى ایجاد کرده بود که متکى بر اصولى همچون اصل تساوى، اصل انحصار، اصل غیرنظامى بودن دریا، اصل همکارى و... بود. ولى پس از فروپاشى شوروى و مطرح شدن پدیده جانشینى در آن کشور و تشکیل کشورهاى جدید ترکمنستان، قزاقستان و آذربایجان، در روابط حقوقى آن مشکلاتى حادث شده و تک روی هاى برخى از این کشورهاى تازه استقلال یافته شبهاتى بر وضعیت حقوقى دریاى خزر بوجود آورد که مى‏ تواند پیامدهاى سیاسى و اقتصادى نامطلوبى را به همراه داشته باشد.  نگارنده با استفاده از روش تحلیلى و اسنادى ضمن اشاره به وضعیت حقوقى گذشته این دریا، مشکلات بوجود آمده در رژیم حقوقى آنرا پس از فروپاشى شوروى سابق مورد بررسى و تجزیه و تحلیل حقوقى قرار داده و به این نتیجه رسیده است که وجود یک رژیم حقوقى معتبر، روشن و مستحکم و مبتنى بر معاهدات فیما بین قبلى، ضمن حل مشکلات موجود، حق حاکمیت ایران را نیز استحکام مى ‏بخشد.}, keywords_fa = {}, url = {https://www.sepehr.org/article_27951.html}, eprint = {https://www.sepehr.org/article_27951_0583530b835b7e9b11e5c7a7327db256.pdf} }
